Terms and Conditions for the Provision of Electronic Services within the startlist.pl Website

§1 Definitions

Whenever these Terms and Conditions refer to:

  1. Administrator – shall mean LABOSPORT Polska sp. z o.o. (NIP: 5783116536 REGON: 360937446 KRS: 0000543585), with its registered address at: ul. Browarna 86-87, 82-300 Elbląg;
  2. User Account – shall mean the functionality of the Website that allows the use of the Services.
  3. Terms and Conditions – shall mean these Terms and Conditions for the provision of electronic services within the startlist.pl website;
  4. Website – shall mean the website available at startlist.pl;
  5. Services – shall mean the ability to use the functionalities offered from time to time by the Website, including in particular the ability to submit an entry and register the User for an Event and to purchase benefits related to the Event;
  6. User – shall mean an entity that uses the Website, holds a User Account within it, and has accepted these Terms and Conditions;
  7. Event – shall mean a sporting, artistic, mass, integration or other event for which the organizer enables entries to be submitted via the Website.

§2 General Provisions

  1. These Terms and Conditions set out the rules and conditions for the provision of Services by the Administrator via the Website, as well as the rights and obligations of the User relating to the use of the Services.
  2. The Website is a tool enabling Users to submit entries, register, and pay fees for participation in an Event. The organizer of the Event is the entity indicated on each occasion in the information relating to the Event.
  3. The scope of Services provided by the Administrator results from the current functionalities of the Website and may change.

  4. Contact with the Administrator may be made using the details indicated above; however, we recommend contact via e-mail or the contact form made available on the Website, as these are the means that ensure the shortest waiting time for a message to reach the Administrator.

§4 Terms for the Provision of Services

  1. Using the Services requires acceptance of these Terms and Conditions and the creation of a User Account in accordance with the instructions provided on the Website.
  2. Creating a User Account requires access to the Internet and an active e-mail address.
  3. The User is obliged to keep confidential the login and password used to log in to the User Account.
  4. Use of the User Account is free of charge. Depending on the rules established by the organizer, registration for particular Events or the purchase of benefits related to an Event may require the User to pay fees indicated in the Event's terms and conditions and specified during registration.
  5. The purchase of certain benefits related to an Event may be subject to a fee and be governed by the provisions of the Terms of Purchases made via the startlist.pl website
  6. The User may, free of charge, cancel the User Account at any time after logging in to it. Following cancellation of the User Account, the Administrator will delete the User Account and all data provided to the Website by the User.

§5 Conditions for Using the Services

  1. A User wishing to register their participation in a chosen Event should familiarize themselves with the terms and conditions of that Event as set by its organizer.
  2. In order to submit an entry for an Event, the User should follow the instructions provided on the Website, including submitting any declarations required by the organizer of the Event.
  3. After an entry has been submitted, the User's first and last name is entered on the Event's start list, which will be confirmed by an e-mail message sent to the User.
  4. Within 7 days of registering for an Event, the User should pay the entry fee. Payment of the fee may be made through the Services currently offered (separate and independent electronic payment operators, operating under their own published terms and conditions) or by bank transfer to the Administrator's account, made in accordance with the instructions provided on the Website.
  5. Once the entry fee has been credited, the User will receive an automatically assigned start number.
  6. Administrator may send information concerning the Event to which an entry relates using the e-mail address or telephone number provided by the User.
  7. The User consents to their image being recorded during the Event using any technique, and consents to the Administrator's use of the image so recorded exclusively for informational, promotional and marketing purposes related to the Event. This consent covers the use of the image across all fields of exploitation referred to in Article 50 of the Act on Copyright and Related Rights. The User consents to the processing of their image through cropping, digital editing, composition, and combining with other images or the images of other persons, to the extent necessary for the purposes described above.
  8. Registration of persons under 16 years of age may be carried out by their statutory representative or legal guardian. An adult User may also register the participation of a minor in an Event using the appropriate function of the Website available under the "My Dependents" tab.
  9. The User may not use the Website to introduce content of an unlawful nature into it.
  10. A User who, when registering a User Account, gives the relevant consent may receive a newsletter informing them about upcoming Events.

§6 Personal Data

  1. Personal data provided by Users is protected as personal data within the meaning of the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter GDPR).
  2. The Administrator processes personal data for the purpose of providing the Services, in particular registration on the website, participation in competitions, performance of services related to participation in competitions, publication of results and start lists, handling of complaints, pursuit of claims, and fulfilment of tax obligations.
  3. Personal data may be disclosed by the Administrator to entities cooperating with it in the performance of services, on the basis of data processing entrustment agreements, in accordance with applicable data protection law (in particular to individual event organizers, if they are entities other than the Administrator, IT service providers, results measurement providers, printing services, etc.)
  4. The User has:
    1. the right to withdraw consent to the processing of data
    2. the right to access personal data and the right to request its rectification, erasure, or restriction of its processing
    3. other rights set out in the Privacy Policy.

§7 Complaints Procedure

  1. The User may file complaints regarding the Services provided by the Administrator using the contact details specified in § 3 of these Terms and Conditions.
  2. The Administrator will respond to a submitted complaint within 14 days of its receipt.

§8 Final Provisions

  1. The Administrator may amend the provisions of these Terms and Conditions only for valid reasons, including, among others, changes to the functionality of the Website and changes in the law affecting the provision of the Services.
  2. Information about a planned amendment to the Terms and Conditions will be sent to the User's e-mail address provided in the User Account at least 7 days before the changes take effect.
  3. If the User does not object to the planned changes before they take effect, they are deemed to have accepted them.
  4. If the User does not accept the planned amendments to the Terms and Conditions, they should provide such information to the e-mail address indicated in § 2, which will result in the deletion of the User Account (i.e. termination of the service agreement) when the planned changes take effect.
  5. The Administrator reserves the right to discontinue the provision of the Services, which will involve the deletion of all data collected on the Website, and Users will not be entitled to any claims in this respect.
